Alimony Payments
The courts in Montgomery and Auburn will consider the following possibilities for awarding alimony (spousal support) payments. We can argue your preferences and push for an arrangement that best suits your needs, either as the provider or recipient of alimony payments.
Temporary Alimony
Alimony may be awarded only temporarily, while the divorce is pending. It is provided as support for the dependent spouse in the marriage, usually until the divorce is finalized.
Rehabilitative Alimony
This form of spousal support is paid over a time period specified by the court in order to enable a dependent spouse to achieve whatever goals need to be met before they can support themselves. Rehabilitative alimony payments are made until the designated goals are attained (a college degree, completion of vocational training, etc.), so long as the recipient continues to show they are working to achieve their required goals in good faith.
Periodic Alimony
Periodic support payments are made over a period of time designated by the court. These payments typically end once the receiving party remarries, enters into a cohabitation agreement, or either spouse passes away.
Lump Sum Alimony
Alimony is paid in a single amount to a receiving spouse. The lump sum is fixed by the court and cannot be modified or cancelled due to any changes in circumstance that may affect either party.
Child Support Payments
Our Auburn divorce lawyers believe in protecting the rights of children. Toward that end, we assist custodial parents (the parent with whom a child physically resides), non-custodial parents, and stepparents who want to ensure that the children of divorce:
- Are properly fed, clothed, and sheltered
- Can continue to attend the same schools, camps, and activities
- Receive all necessary medical care
- In general, continue to live the same lifestyle they enjoyed prior to the divorce
Visitation Rights
Visitation agreements enable non-custodial parents to continue to share quality time with their children. We believe these visits are vital to reinforcing a child’s sense of being loved. However, we also recognize that under some conditions, visitation may not be in the best interests of the child, or original visitation agreements may need to be modified (changed) in order to accommodate a move or other change in lifestyle. Whatever the situation, we can assist parents in reaching acceptable visitation arrangements that protect their children’s health, welfare, and emotional well-being.
